-1- Abstract Counsel in the Criminal Proceedings: The objective of our Diploma Thesis is to analyze the currently valid law governing the counsel's position in the criminal proceedings, to evaluate its sufficiency or insufficiency and to provide views and proposals in the sense of 'de lege lata' and 'de lege ferenda', focusing more in detail upon some partial aspects which are closely related to the counsel's position during the criminal proceedings. Good quality law system relating to the counsel's position in the criminal proceedings, his/her process rights and obligations is an assumption for meeting the criminal proceedings purpose and is reflected in the possibility to provide to the accused efficient legal counselling and thus meet the accused person's right of defence and fair trial (process) which is guaranteed by the Constitution. The counsel as an actor operating in the criminal proceedings plays a significant role in enforcing the rights and justified interests of the accused. The counsellor masters the legal argumentation, strategy and tactics of the defence, is able to better formulate ideas, to draw ideas from the experience gained in former law suits, whilst for the accused person his/her position is entirely new and unknown, many time it is the first experience in life. Studie popisuje institucionální a rozhodovací rámec společné zahraniční a bezpečnostní politiky v kontextu změn, které v této oblasti přinesla Lisabonská smlouva. Společná zahraniční a bezpečnostní politika je Lisabonskou smlouvou prostřednictvím společných cílů propojena s dalšími činnostmi Unie, které mají dopad na unijní vnější vztahy, jako je např. společná obchodní politika nebo rozvojová politika. S tím souvisí vytvoření nové funkce Vysokého představitele Unie pro zahraniční vztahy bezpečnostní politiku, který personálně propojuje činnost Rady a Komise v oblasti vnějších vztahů. V oblasti rozhodovacích procesů k žádné podstatné změně nedošlo, nadále je smluvně chráněn státní zájem, který umožňuje členskému státu vetovat rozhodnutí. Autor konstatuje, že i přes výrazné změny, které Lisabonská smlouva přináší, především pokud jde o institucionální strukturu společné zahraniční a bezpečnostní politiky a její propojení s vnějšími vztahy Unie prostřednictvím společných cílů, společná zahraniční a bezpečnostní politika je i nadále vytvořena jako svébytný pilíř evropské integrace.

Right to a Defense of Socially Disadvantaged Groups in the Criminal Proceedings

The Right to Counsel is one of a fundamental principle of criminal proceedings. This right is enshrined and governed in § 2, paragraph 13, § 33 and following of Act No. 141/1961 Coll. On Criminal Proceeding (Criminal Procedure). The Right to Counsel is guaranteed, in addition to the Constitutional laws, by the Criminal Procedure Code and the Charter of fundamental rights and freedoms in Article 40, paragraph 3 and also by International Conventions such as the European Convention on Human Rights and Fundamental Freedoms. The target of my Thesis is to clarify the issue of availability of the Right to free Counsel or Counsel for reduced fee for socially disadvantaged groups in criminal proceeding. For the purposes of my Thesis, young, unemployed, handicapped people and people serving in Prison in České Budějovice, are considered to be socially disadvantaged. The Thesis surveys the availability of the rights to counsel for disadvantaged groups in criminal proceedings in the light of valid and effective legislation of the Czech Republic.
